Event and Time
Event Description
Charlotte Pass Snow Resort Pty Ltd was charged with two offences under the Protection of the Environment Operations Act 1997, namely:
- One count of polluting waters by discharging partially treated sewage effluent into a creek with elevated levels of ammonia and total nitrogen.
- One count of breaching its Environment Protection Licence by failing to maintain the sewage treatment plant (STP) diffusers in proper condition.
Application and Claims
- Offences Charged: Violation of s 120(1) (pollution of waters) and s 64(1) (breach of licence).
- Time Frame: The offences occurred between 9 July and 24 September 2019.
- Prosecutor: NSW Environment Protection Authority (EPA).
- Defendant: Charlotte Pass Snow Resort Pty Ltd.
Judicial Decisions
Charlotte Pass pleaded guilty to both offences. The court found that the discharges caused actual and potential environmental harm, despite the actual harm being limited in scope. Various factors were considered in sentencing, including the seriousness of the offences, the level of contrition demonstrated by the defendant, and the practical measures that could have been taken to prevent harm. The Court imposed fines and ordered costs to be paid to the EPA.
Dispute Points and Legal Basis
Dispute Points
Prosecution (EPA)
- Claims: The discharge of effluent from the STP was above the permissible ammonia and total nitrogen levels, violating the licence conditions.
- Evidence: Testing data showed concentrations exceeding regulatory limits and potential environmental damage to surrounding waters, particularly affecting aquatic life.
- Reasoning: The maintenance failures directly led to elevated contaminant levels in the effluent.
