Dispute Points and Legal Basis
Dispute Points
Mr. Kadhim’s Position:
- Claims that his psychiatric injury severely limits his ability to work and function in daily life.
- Asserts that he is unable to earn 60% of his pre-injury earnings due to his health conditions.
- Presents evidence from medical professionals who support the severity and permanence of his injuries.
Victorian WorkCover Authority’s Position:
- Argues that Mr. Kadhim’s injuries are not serious and are linked to pre-existing conditions.
- Contends that Mr. Kadhim is capable of returning to work if he is motivated.
- Suggests that his psychiatric state and knee issues involve non-organic components and questions Mr. Kadhim’s credibility.
