Dispute Points and Legal Basis
Dispute Points
- Builder's (Renbar's) Claim:
- Asserts the right to claim unpaid fees for completed work despite alleged non-compliance with contract claim requirements. - Claims the work performed presented a net value exceeding what has been paid.
- Owner's (Dr Sader's) Defense:
- Argues that non-compliance with contract payment claim procedures voided Renbar's right to recover any additional sums. - Cited concerns over cost overruns, delay, and insufficient communication regarding expenses and project management.
- Expert Testimony:
- Dr Sader's expert evaluated the construction cost based on a standard cost guide, opposing Renbar’s claim for higher costs. - Renbar's accounting showed expenses were necessary and justified.
