Dispute Points and Legal Basis
Dispute Points
- Mackay Parties' Position:
- Sought indemnity costs based on multiple offers made pre-trial and during the proceedings. - The August Offer included not only a purchase offer but also coverage of Premier's costs.
- Mr. Sharp and Sallab's Position:
- Argued for indemnity costs claiming they were wrongly joined in the proceedings. - Relied on offers made to seek costs from specific dates through to the trial.
- Premier's Position:
- Contended that only standard costs should be awarded and argued against indemnity costs for specific defendants (Sallab and Mr. Sharp). - Asserted that the defendants' claims on costs were excessive and should be limited to essential costs associated with filing defenses and attendance.
