Event Description
On 20 November 2023, an urgent application was made before the Commercial Court by the Plaintiff, Birchip Holdings Pty Ltd, seeking an interlocutory injunction regarding the sale of a land property located at 62 Arrowsmith Street, Beveridge, Victoria. The application arose just before the scheduled settlement of the property, which was set for the same day.
Application and Claims
Birchip's application included:
- (a) An interlocutory injunction to prevent the First and Third Defendants from proceeding with the sale of the property until further court order or Birchip's consent.
- (b) An order for discovery of documents related to the sale negotiations and contract of sale from the First and Third Defendants, covering:
- Correspondence on commercial negotiations. - Exchange of the contract of sale. - Payment evidence for the deposit. - Correspondence indicating the introduction of the First Defendant as the vendor and the Third Defendant as the purchaser.
