Event and Time
Event Description
The applicant was charged with several serious offenses, including sexual assault of a child under 16, supply of a drug of dependence to a child, and failure to comply with reporting obligations under the Sex Offenders Registrations Act. After a bench trial held from 16 to 18 March 2021, the judge acquitted the applicant of one charge, convicted him on two charges, and the applicant was sentenced to imprisonment on 24 August 2021. The applicant later sought leave to appeal against his conviction on multiple grounds and applied for an extension of time to file his appeal.
Application and Claims
The applicant presented four grounds for appeal: 1. The trial judge’s verdict could not be supported by the evidence. 2. The trial judge erred in reasoning regarding the failure to call witnesses during sentencing. 3. The trial judge did not view evidence dispassionately. 4. The evidence at trial was based on false depositions.
Judicial Decisions
The trial court acquitted the applicant of one charge but convicted him on two others, leading to a total effective sentence of 4 years and 3 months’ imprisonment. The applicant's extension for leave to appeal was later granted given the difficulties he faced during the COVID-19 pandemic and complications in compiling the necessary documents.
