Event and Time
Event Description
On 2 December 2020, Stephen Tate, a teacher at Bracken Ridge State High School, distributed a leaflet from QTeachers First Inc trading as Teachers Professional Association of Queensland (TPAQ) to fellow teachers. The leaflet encouraged them to consider joining TPAQ instead of the Queensland Teachers Union of Employees (QTU). This led to a dispute stemming from a memorandum distributed by QTU representatives, Noel Gibson and Kellie Insch, which claimed TPAQ was not a recognized union in Queensland and could not negotiate Enterprise Bargaining Agreements or represent the industrial rights of employees.
Application and Claims
- Applicant: Stephen Tate (via TPAQ) asserts that the memorandum distributed by QTU constituted a misrepresentation and violated Section 345 of the Fair Work Act 2009 (Cth).
- Respondents: Noel Gibson and Kellie Insch (representatives of QTU) allegedly made false claims about TPAQ's status as a union.
Judicial Decisions
The court dismissed the application filed on 28 February 2021. The Court also noted that it may vary or set aside an order for minor errors in accordance with relevant court rules.
