Event and Time
Event Description
Between December 2009 and July 2013, Joann Ross (the plaintiff) was employed at Gruma Oceania Pty Ltd (the defendant), a manufacturer of tortillas and tacos. The plaintiff primarily worked on the tortilla line during her night shifts. The plaintiff experienced a fall at work on 26 July 2012, which resulted in injuries. Following her recovery, she claimed to suffer psychic injuries attributed to bullying, intimidation, and harassment upon returning to work between April and July 2013.
Application and Claims
The plaintiff initiated legal proceedings in January 2020, seeking damages for:
- Injuries sustained from the fall (the fall claim).
- Psychological injuries resulting from alleged workplace bullying during her return (the return to work claim).
The plaintiff accused the defendant of negligence, along with its employees and agents, for causing these injuries.
Judicial Decisions
In July 2021, a County Court jury adjudicated the case, returning a verdict:
- No negligence concerning the plaintiff’s fall.
- Determined negligence regarding the plaintiff's return to work.
- Ruled that this negligence did not cause the claimed psychiatric injury.
On 29 July 2021, the judge confirmed the jury's verdict, resulting in judgment for the defendant.
