On April 22, 2019, the applicant was arrested by police after a fight occurred in a carpark while transferring her children from her estranged husband's care to her own. The applicant was charged with recklessly inflicting grievous bodily harm and assault occasioning actual bodily harm against her estranged husband. The charges were filed two weeks post-incident after the husband sought police intervention.
Application and Claims
The applicant initiated proceedings against the State of New South Wales, arguing three causes of action:
- Trespass to property due to police entry into her home.
- False imprisonment regarding her arrest and subsequent detention.
- Misfeasance in public office, claiming the arresting officer wrongfully arranged for the children to be transferred to their father’s care during the arrest.
Judicial Decisions
The District Court judge, Weber SC DCJ, dismissed the claims but provisionally assessed damages for false imprisonment at $10,000, conditional upon the dismissal being erroneous. The applicant sought leave to appeal regarding the false imprisonment claim, which was granted, but ultimately, the appeal was dismissed, and the non-publication order was maintained. The applicant was also ordered to pay the costs of the State of New South Wales.
