Event and Time
Event Description
On 8 November 2022, the plaintiff initiated an Originating Motion under s328(2) of the Workplace Injury Rehabilitation and Compensation Act 2013 seeking leave to commence damage proceedings for injuries sustained during employment with Chobani Australia Pty Ltd. Hearings were scheduled, and an Order 42A subpoena was issued by the defendant on 29 April 2024, seeking access to the plaintiff's medical files from Durrant Medical Clinic. The plaintiff objected to disclosing materials citing legal privilege. An objection hearing occurred on 24 June 2024.
Application and Claims
- Plaintiff's Claims: The plaintiff sought to protect communications deemed privileged under legal statutes, arguing that disclosures made during doctor visits should remain confidential.
- Defendant’s Claims: The defendant contended that the plaintiff's discussions with his doctor constituted an implied waiver of legal privilege, therefore permitting access to the medical records.
Judicial Decisions
The judge reviewed claims of legal privilege based on the Evidence Act 2008, particularly section 122 relating to loss of client legal privilege, and ruled primarily on the nature of the communications between the plaintiff and his general practitioner. The Court determined that certain entries containing privileged information should be redacted while allowing the remainder of the records to be inspected by the defendant.
