Event and Time
Event Description
In September 2021, a domestic violence victim (the plaintiff) was provided accommodation by Good Shepherd Australia New Zealand (the first defendant) at a location owned by Homes Victoria (the second defendant). Due to the COVID-19 pandemic and the plaintiff's unwillingness to accept alternative accommodation, her stay extended beyond the initially intended 6 to 8 weeks. The plaintiff alleges threats made by the first defendant to leave the premises and claims her complaints to the second defendant have not been addressed. Representing herself, she seeks damages and long-term housing to rebuild her life.
Application and Claims
The first defendant sought suppression orders under s 18(1)(c) of the Open Courts Act 2013 to prevent the disclosure of sensitive information regarding their crisis accommodation services to protect the safety of their clients. The plaintiff opposed this application, citing a medical emergency but failed to provide sufficient evidence to support her claims and demands to contest the order.
Judicial Decisions
The court considered the necessity of imposing suppression orders in light of the Open Courts Act. It noted that while the identification of crisis accommodation locations could jeopardize the safety of domestic violence victims, the suppression of employee identities was not supported by evidence showing harm from such disclosure. The court granted the first defendant's application for suppression regarding accommodation addresses but declined to suppress employee information.
