Event and Time
Event Description
- On 27 January 2022, the Supreme Court made orders to wind up ENA Development Pty Ltd and appointed Mr. Peter Krejci as the liquidator.
- On subsequent dates, further orders were made, including appointing Mr. Krejci as receiver of the assets of the ENA Development Trust and addressing vexatious proceedings pertaining to multiple parties.
Application and Claims
- The Liquidator and ENA Development filed a motion under the Vexatious Proceedings Act 2008 (NSW) against several defendants including Mr. Robert Sebie, claiming that their actions constituted vexatious proceedings.
- Plaintiffs sought orders prohibiting defendants from instituting further proceedings without court permission.
Judicial Decisions
- Extensive hearings occurred from 24 April to 5 May 2023, resulting in judicial findings on the vexatious nature of multiple proceedings instituted by the defendants, leading to determinations of a protective order against future vexatious claims.
Dispute Points and Legal Basis
Dispute Points
- Plaintiffs (Liquidator and ENA Development):
- Asserted that the defendants had engaged in numerous vexatious proceedings related to the winding up of ENA Development. - Provided evidence of past proceedings that caused unnecessary litigation costs and operational burdens.
- Defendants (including Mr. Sebie and Jemmott):
- Claimed other legal proceedings should take precedence, alleging that plaintiffs’ moves constituted abuse of process and infringement of rights to appeal against prior judgments. - Argued that decisions borrowed from other jurisdictions concerning ownership and trust related to ENA Development should govern the current proceedings.
