Event and Time
Event Description
On 26 October 2021, Ms. Lotte (the wife) commenced property settlement proceedings against Mr. Inger (the husband) in the Federal Circuit and Family Court of Australia (Division 2). During the proceedings, on 25 May 2022, a litigation guardian was appointed for the husband. The case was heard on an undefended basis, leading to a ruling on the division of property. An appeal was subsequently filed by Mr. Inger on 12 March 2024.
Application and Claims
- The appellant claims natural justice was denied.
- Allegation of no service of documents by the other party.
- Claim that only 32 minutes' notice of the final hearing was received.
- Request for additional time to file for special leave in the High Court, estimating a need for approximately six weeks.
Judicial Decisions
The appeal was listed for a "show cause" hearing to determine whether it should be summarily dismissed. The appeal was ultimately dismissed on the basis that it had no reasonable prospects of success.
Dispute Points and Legal Basis
Dispute Points
1. Claim of Denied Natural Justice: - Appellant's Argument: Asserts that the proceedings did not afford a fair chance to present his case. - Opposition's Argument: Natural justice was upheld as all legal procedures were followed in the original trial.
2. No Service of Documents: - Appellant's Argument: Contends he did not receive important court documents that would affect his ability to defend himself. - Opposition's Argument: All required documents were served as per the appropriate legal protocols.
3. Insufficient Notice: - Appellant's Argument: Claims receiving only 32 minutes' notice of the hearing hindered his opportunity to prepare adequately. - Opposition's Argument: The notice period complied with the rules necessary for the proceeding.
