Event and Time
Event Description
An Afghan national applied for a Safe Haven Enterprise Visa (subclass 790) after arriving in Australia by boat in November 2021. His application was assessed, and the Immigration Assessment Authority (IAA) concluded that he could reasonably relocate within Afghanistan, which he contested in a judicial review.
Application and Claims
The Applicant made various claims regarding the dangers he faced in Afghanistan, including:
- Fear of harm from the Taliban due to his family's involvement with the government.
- Risks associated with his Tajik ethnicity and Shi'a faith.
- Personal history of violence from the Taliban and inability to safely relocate within Afghanistan due to increasing insecurity.
The IAA assessed these claims and ultimately dismissed the application, prompting the Applicant to seek a judicial review on the grounds of the IAA's alleged failures to consider key factors regarding his claims.
Judicial Decisions
The application for judicial review filed on April 5, 2017, and amended on September 22, 2021, was dismissed. The Applicant was ordered to pay the First Respondent's costs, fixed at $7,853, with the First Respondent being amended to "Minister for Immigration, Citizenship and Multicultural Affairs."
Dispute Points and Legal Basis
Dispute Points
1. Ground 1: The IAA allegedly failed to consider the impact of the withdrawal of foreign troops on security in Afghanistan. - Applicant's Argument: The deteriorating security situation was materially significant and should have been actively engaged in the IAA's decision-making process. - Minister's Counter: The IAA had sufficiently considered this situation as a factor without expressly referencing it in decision-making.
2. Ground 2: The dangerous condition of roads was not adequately considered by the IAA. - Applicant's Argument: The safety of travel was critical, given the risk of attacks and was a necessary factor in assessing the reasonableness of relocating to Mazar-e-Sharif. - : The risks associated with travelling were alluded to but deemed manageable by the IAA since air travel to Mazar-e-Sharif was deemed safe.
