Event and Time
Event Description
- Date of Incident: 14 November 2011.
- Nature of Incident: Ms. Nuray Ozcan, a worker, suffered injuries to her lumbar spine, thoracic spine, and right shoulder during a workplace accident. She later sustained additional injuries to her lumbar and thoracic spine in subsequent incidents on 3 May and 26 September 2012.
Application and Claims
- Initial Claim: Ms. Ozcan filed a claim under the Workers Compensation Act for permanent impairment compensation due to her injuries. A referral was made for assessment by an Approved Medical Specialist (AMS).
- AMS Assessment: The AMS determined the degree of permanent impairment (WPI) at 15%, broken down as follows:
- 3% for the right shoulder - 5% for the thoracic spine - 7% for the lumbar spine
- Disputed Outcome: The AMS found the right shoulder injury was not attributed to the subsequent injuries, leading to an apportionment of WPI.
- Appeal: Ms. Ozcan appealed the Deputy President Wood's determination that resulted in her being ascribed a 12% WPI, arguing for aggregation of her WPI assessments.
Judicial Decisions
- Decision by Deputy President Wood: Determined Ms. Ozcan’s right shoulder injury could not be aggregated with her spinal injuries as they did not "arise out of" the same incident under the relevant statutes.
- Appeal Court Decision:
- Granted leave to appeal. - Set aside Deputy President’s orders. - Ordered compensation based on a 15% WPI instead of 12%.
Dispute Points and Legal Basis
Dispute Points
- Ms. Ozcan’s Argument:
- Her injuries from all incidents should be aggregated under sections 65 and 322 of the relevant Acts, as they were causally connected. - The initial injuries "resulted from" the incident and contributed materially to later injuries, thus meeting the statutory criteria for aggregation.
