Event and Time
Event Description
Victor Tran operated a dental practice under a lease with Binghua Guan and Guixing Jian. Following repeated failures to pay rent, the lease was terminated on 19 August 2020. Mr Tran was allowed limited access to the premises until 27 August 2020, after which he initiated legal action against the lessors for the return of dental equipment he claimed ownership of, which remained on the property after termination.
Application and Claims
Tran sought recovery for alleged detinue and conversion of dental equipment, arguing he was entitled to remove his goods after lease termination. He contended that he retained ownership of the items and was denied a reasonable period to retrieve them. In contrast, the lessors argued that due to the lease termination, ownership of the goods reverted to them.
Judicial Decisions
1. Proceedings regarding the 10 undisputed items were dismissed. 2. Plaintiffs (Tran and Tamvic Pty Ltd) ordered to pay the defendants' disbursements related to the defense. 3. The matter was scheduled for further directions.
Dispute Points and Legal Basis
Dispute Points
- Plaintiffs' Claims (Tran/Tamvic Pty Ltd):
- Asserted ownership of 10 undisputed dental items (including dental chair, suction unit, etc.). - Argued for a reasonable period to remove goods after lease termination, claiming denial of access by defendants.
- Defendants' Arguments (Guan Sr and Jian):
- Claimed that upon lease termination, the goods were forfeited and became their property, as outlined in the lease. - Stated that Mr Tran was already aware of the potential for termination due to unpaid rent and did not take timely action to secure his goods. - Indicated refusal of access was based on treating the items as their own.
