- The plaintiffs seek an order for the defendant to provide an account concerning these transactions and financial dealings.
Judicial Decisions
- The court addressed whether the plaintiffs had standing to bring the proceeding against the defendant.
- The application from the defendant for summary judgment based on standing was dismissed, and the proceeding was stayed pending the resolution of existing proceedings related to the estate.
Dispute Points and Legal Basis
Dispute Points
Plaintiffs' Claims:
- Assert breach of fiduciary duties by the defendant concerning financial transactions on behalf of the deceased.
- Claim that the defendant retained sale proceeds of properties that the deceased was entitled to, thus violating trust obligations.
- Argue that the defendant’s actions lead to a loss to the estate, justifying the need for accountability and declarations regarding property.
