Event and Time
Event Description
On February 13, 2021, Shane Rodney Fellows committed an aggravated burglary and theft at Eastbridge Court, Nunawading. He entered an unlocked townhouse in search of an individual allegedly threatening friends and other residents. Upon entry, he briefly interacted with 14-year-old Gheorghe Ansell, subsequently leaving the property. Upon police intervention, Fellows was found with stolen sunglasses belonging to Ansell.
Application and Claims
Fellows pleaded guilty to one count of aggravated burglary and one count of theft. He acknowledged his prior criminal history and accepted the prosecution's summary of events for sentencing, which described his intent to locate Cameron Lamont and his actions during the burglary.
Judicial Decisions
The judge noted the objective gravity of the offense was lower for aggravated burglary given the lack of force, weapons, or assault during the entry. Despite his extensive criminal history and the serious nature of the charge, the court considered mitigating factors related to his personal history, mental health, and early guilty plea.
Dispute Points and Legal Basis
Dispute Points
- Prosecution Argument:
- Argues that aggravated burglary is a serious offense with penalties reflecting the need for deterrence and community protection. - Emphasizes his criminal history and the need for a strong sentence due to the nature of the offense.
- Defense Argument:
- Mitigating factors include his personal history of abuse, mental health issues, and supportive rehabilitation needs. - Claims that the totality principle and his acquired brain injury lessen his moral culpability. - Asserts that the nature of the offenses and Fellows' prompt guilty plea warrant a less severe sentence.
