Event Description
In January 2014, UDP Holdings Pty Ltd purchased a dairy business from Esposito Holdings Pty Ltd, owned by Antonio Esposito. Following the business's collapse, disputes arose concerning the purchase, leading to arbitration. The arbitrator awarded UDP Holdings a constructive trust over the purchase price, which was upheld by the Supreme Court of Victoria in October 2018.
Application and Claims
Following the arbitration award, UDP Holdings sought to trace the proceeds of the constructive trust into four properties acquired by AE Brighton Holdings Pty Ltd, Mr. Esposito's second company. The properties were:
- 2 Kinane Street, Brighton
- 92 The Esplanade, Brighton
- 639 and 649 Williams Road, Werona
- 101 Trunk Lead Road, Bunkers Hill
UDP Holdings claimed equitable interests in these properties, backed by the arbitrator's findings.
Judicial Decisions
On 26 August 2021, the court ruled in favor of UDP Holdings, recognizing its equitable interests in the proceeds from the sale of the properties. The judgment included detailed declarations regarding the funds held in court relating to each property.
