Event and Time
Event Description
Diako (the Plaintiff) sought judgment against Compfam (the Defendant) under Section 16(2) of the Building and Construction Industry Security of Payment Act 2002 (Vic) (SOP Act). The application arose from construction works performed by Diako at the Site on 316 Gallagher’s Road, Glen Waverley, with Compfam failing to respond to a payment claim by providing a payment schedule or making the requisite payment.
Application and Claims
- Diako's Claim: Diako claimed that it was entitled to payment for construction work performed, amounting to $136,849.23 (inc. GST), on the grounds that Compfam had neither made a payment nor issued a payment schedule in response to the payment claim.
- Compfam's Defence: Compfam opposed the claim on two grounds:
1. The payment claim lacked a valid reference date. 2. The payment claim contained excluded amounts.
Judicial Decisions
The court found for Compfam, ruling that Diako’s summons was dismissed, and Diako was ordered to pay Compfam's costs. The court's reasoning focused on the validity of the payment claim and its compliance with statutory requirements under the SOP Act.
Dispute Points and Legal Basis
Dispute Points
- Plaintiff's Arguments (Diako):
- Diako submitted that it had made a valid payment claim under the SOP Act. - It argued that the arrangement with Compfam and communications facilitated the establishment of a reference date for the payment claim. - Diako maintained that the payment claim did not include any excluded amounts as defined under the SOP Act.
- Defendant's Arguments (Compfam):
- Compfam contended that the payment claim lacked a reference date from which payments could be calculated. - It asserted that the payment claim contained excluded amounts, which invalidated the claim under the SOP Act. - Compfam also initially raised the issue that the contract fell under domestic building arrangements as per the Domestic Building Contracts Act 1995 (Vic), but later retracted this claim.
