Event Description
- On the evening of 9 December 2017, in Castley Crescent, Braybrook, a series of violent incidents occurred involving four men: Salah Abukar, Dawuud Abdi, Abdifatah Sharif, and Ahmed Sharif. These events led to the death of Paul Duncanson and serious injuries to his brother, Sean.
Application and Claims
- The applicants, Abukar and Abdi, were indicted on charges of:
- Intentionally causing serious injury. - Recklessly causing serious injury. - Affray.
- Ahmed was indicted for murder but later pleaded guilty to manslaughter.
Judicial Decisions
- The jury was empaneled on 7 October 2019, and key evidence, including Ahmed's record of interview, was presented.
- Despite the arguments of Abukar and Abdi that Ahmed's testimony was prejudicial, the judge refused their applications to discharge the jury. The jury ultimately found Abukar and Abdi guilty on charges related to the serious injury and affray.
