Event and Time
Event Description
In May 2021, the liquidator of Zorro Pressure Cleaning Pty Ltd initiated proceedings against Mr. Wiggett and Mrs. Wiggett in the District Court, asserting claims of insolvent trading and seeking recovery of debts resulting from such trading. Concurrently, a family law matter involving claims for property division was initiated by Mrs. Wiggett in the Federal Circuit and Family Court of Australia, following their divorce in October 2020. Mr. Wiggett sought to have the District Court proceedings transferred to the Federal Circuit and Family Court, arguing that they were intertwined and that having both matters disposed of by the same court would better serve the interests of justice.
Application and Claims
- Liquidator's Claims (Mr. Stone):
- Asserts that Mr. and Mrs. Wiggett failed to prevent Zorro from incurring debts while insolvent, contrary to s 588G of the Corporations Act 2001 (Cth). - Claims a total recovery of $202,546.27, of which $151,558.86 relates to alleged insolvent trading.
- Defendants' Position (Mr. and Mrs. Wiggett):
- Deny the claims of insolvent trading. - Assert Mrs. Wiggett was not a de facto or shadow director. - Seek to transfer the case to resolve potential conflicting legal findings and procedural efficiency.
Judicial Decisions
The Court refused to transfer the District Court proceedings to the Federal Circuit and Family Court. It dismissed the proceedings against the defendants, ordering that the costs are followed by the event under Uniform Civil Procedure Rules 2005 (NSW).
