Event and Time
Event Description
On 23 August 2022, a jury in the County Court convicted Luke Merryfull of one charge of rape and Shaun Bloomfield of two charges of rape and one charge of sexual assault. The offenders targeted a single complainant referred to as ‘C’.
Application and Claims
- Merryfull was convicted on one charge of rape, while Bloomfield was convicted on two charges of rape and one of sexual assault.
- Both offenders were sentenced on 12 April 2023, with Merryfull receiving a total effective sentence of 1 year and 7 months’ imprisonment along with a 2-year community correction order (CCO). Bloomfield acknowledged the necessity of general deterrence in his case, which the sentencing judge also considered.
Judicial Decisions
- The sentences imposed on Merryfull and Bloomfield raised questions about the adequacy and proportionality of the punishment given the nature of their offenses.
- The prosecution argued for appeals based on purported errors in sentencing relating to the principles of general deterrence, manifest inadequacy, and proper consideration of the unique circumstances of the case.
Dispute Points and Legal Basis
Dispute Points
- General Deterrence (Ground 2): Bloomfield acknowledged its importance but also highlighted the need to temper it with the specifics of their case. Merryfull and the prosecutor did not address this.
- Manifest Inadequacy (Ground 3): The prosecution argued that the sentences were "wholly outside the range" available to the judge due to the serious nature of the offenses and the moral culpability of both Merryfull and Bloomfield. The prosecution highlighted the breach of trust involved with C, and the manipulative actions taken by both defendants during the assaults.
- The defense cited the age of the respondents at the time of the offenses (21 years) and their good character, as well as the lengthy delay in the proceedings.
