Event and Time
Event Description
Giovanni Mantovani and his siblings are involved in a legal dispute concerning the estate of their mother, Teresa Mantovani, who died in 2015. The estate includes properties, some of which were transferred to the Mantovani Family Trust, managed by Vanta Pty Ltd. Giovanni claims he is a beneficiary of the Family Trust and is seeking access to its documents to understand its administration due to ongoing disputes regarding the distribution of Teresa's estate.
Application and Claims
Giovanni filed an originating motion on 21 February 2019 against Vanta and his siblings (defendants) seeking:
- Production of Family Trust documents from 2008 to present.
- A declaration that if the trust deed is lost, all assets held by Vanta are under a resulting trust for Teresa's estate.
- Accounts and any amounts due to the estate.
On 14 November 2019, Giovanni applied to amend his motion to expand the document retrieval period and categories.
Judicial Decisions
On 17 December 2019, the Judicial Registrar granted leave for Giovanni to amend his originating motion.
Dispute Points and Legal Basis
Dispute Points
- Plaintiff (Giovanni):
- Claims entitlement to information regarding the Family Trust. - Argues that he is a beneficiary of both the original and any reconstituted trust based on a 'Schedule' dated 27 July 1976. - Believes that in absence of the trust deed, assets held by Vanta should revert to Teresa’s estate under a resulting trust.
- Defendants (Nicola, Salvatore, Carmine):
- Contest Giovanni’s claim to be a beneficiary of the trust, asserting that a reconstitution occurred in 2010 excluding him as a beneficiary. - Maintain that extensive searches for the trust deed were unsuccessful. - Argue that Giovanni did not sign documents necessary to 'sign in' as a beneficiary during the alleged reconstitution.
