Dispute Points and Legal Basis
Dispute Points
- Appellant's Argument:
- Claimed that there were "substantial and compelling circumstances" which could warrant a lesser sentence. - Argued that age, a lack of intent to inflict violence, and psychological vulnerabilities should be considered. - Suggested that the current placement in a youth justice centre should mitigate the sentence severity.
- Prosecution Argument:
- Contended that the appellant's offences were grave and committed with significant intent to terrorise, thereby advocating for a stern sentence in line with community expectations and legal precedents. - Emphasized the general deterrence and denunciation of home invasion offences, asserting that personal circumstances should take lesser precedence in light of the severity of the crime.
