During the meeting, the applicant brandished a large butcher’s knife and violently attacked the victim, stabbing him multiple times and inflicting serious injuries before fleeing with the vapes. Subsequently, police found drugs and the knife at the applicant's residence when executing a search warrant.
Application and Claims
The applicant pleaded guilty to the following charges: 1. Armed robbery (max penalty: 25 years, sentenced to 3 years). 2. Intentionally causing serious injury in circumstances of gross violence (max penalty: 20 years, sentenced to 5 years). 3. Trafficking in a drug of dependence (max penalty: 15 years, sentenced to 1 month).
During sentencing hearings that spanned from March to December 2022, the applicant's defense claimed exceptional circumstances existed for aYouth Justice Court (YJC) order based on his compliance with youth justice programs and progress on intensive bail.
Judicial Decisions
The sentencing judge found that there were no exceptional circumstances that warranted a lighter sentence, despite the applicant's compliance with the youth justice regime. The judge cited the extreme seriousness of the applicant’s actions and the need for deterrence in cases involving knife violence among youth.
Dispute Points and Legal Basis
Dispute Points
Applicant's Claims:
- Asserted that exceptional circumstances existed due to his progress in the youth justice system, arguing that his compliance was extraordinary.
- Contended that general deterrence was incorrectly applied and disproportionately affected sentencing.
- Argued the sentence was manifestly excessive due to his age and potential for rehabilitation.
